    The purpose of sending the COPY of the Utility Bill is to serve notification to the tenant(s) of the cost of utilities services.  The tenant(s) will receive a copy of the utility bill and the property owner(s) will continue to receive the original.  

    The property owner(s) are solely responsible for any amount owing, including any fees that are applied as penalties above the regular utility billing.  Payment of the utility bill is to be decided between landlord and tenant as part of the terms of the rent / lease agreement.

    Any amounts outstanding in the Utility account as of December 15 of any calendar year will be transferred to the property owner's tax account in accordance with the Municipal Government Act.  Tax amounts owing at December 31 are subject to a 12% penalty in accordance with the Imposition of Tax Penalties Bylaw.

    In order to begin to receive a copy of the Utility Bill, your landlord / the property owner must submit this authorization form. Please forward your landlord this link if you would like to be added onto the account as a tenant. Renters cannot be added to the account without the landlord / owner's permission.

    Tax Installment Payment Plan (TIPP):  Terms & Conditions

    1. You authorize the Town and its financial institution(s) to continually debit the stated bank account on the 4th day of each month to make payments on your property tax account. 

    2. You acknowledge that when current year taxes are unknown, the debited instalments will be estimated on the prior year's taxes until current year tax information is available for recalculation. 

    3. Your tax account must be at a NIL balance at year end for you to automatically participate in the TIPP program in the following year. Any credit balance on the tax account remaining at the end of the calendar year will be applied to the following year's payments. 

    4. This plan will remain in effect until cancelled. You are responsible to advise the Town, in writing (email acceptable), at least 15 days in advance, of any changes required to the next automatic payment (e.g. payor information, bank account changes, cancellation of the plan, etc.). If there is a change in ownership of the property, you are responsible to notify the Town in writing to cancel the program.

    5. Any payments that are dishonoured by your bank will incur a $25 NSF fee, which must be paid prior to resuming your participation in the program. 

    6. The Town has the right to cancel your participation in the program, per the TIPP Bylaw, if your account is no longer in good standing. 

    7. Monthly payment instalments will be recalculated periodically. You will be notified of calculations that result in changed payments. 

    8. Any correspondence sent by the Town will be directed to the registered owner(s) of the property only. 

    9. By submitting this application to the Town, you are agreeing to be bound by the TIPP Bylaw and the Terms & Conditions of this agreement. 

    10. You have certain recourse rights if any debit does not comply with this agreement. For example, you have the right to receive reimbursement for any debit that is not authorized or is not consistent with this agreement.     1. I acknowledge that the Authorization is provided for the benefit of the Town of Diamond Valley and the Processing Institution and is provided in consideration of the Processing Institution agreeing to process debits against my account, as listed above, (the “Account”) in accordance with the Rules of the Canadian Payments Association.

    2. I warrant and guarantee that all persons whose signatures are required to authorize withdrawals from the Account have digitally signed the Authorization below.

    3. I hereby authorize the Town of Diamond Valley to issue pre-authorized debits (as defined in Rule H1 of the Rules of the Canadian Payments Association) (the “pre-authorized debit”) drawn on the Account, for the following purpose: Payment of Utility Account.

    4. I may cancel the Authorization at any time upon providing written notice to the Town of Diamond Valley 10 days prior to the due date.

    5. I acknowledge that provision and delivery of the Authorization to the Town of Diamond Valley constitutes delivery by me to the Processing Institution. Any delivery of the Authorization to the Town of Diamond Valley, regardless of the method of delivery, constitutes delivery by me.

    6. The Town of Diamond Valley will provide to me at the mailing address provided above:

    a. With respect to fixed amount pre-authorized debits, written notice of the amount to be debited (the “payment amount”) and the dates(s) on which the payment amount debited will be posted to my Account (the “payment date”), at least 10 (ten) calendar days before the payment date of the first pre-authorized debit, and such notice shall be provided every time there is a change in the payment amount or the payment date(s).

    b. With respect to variable amount pre-authorized debits, written notice of the payment amount and the payment date(s), at least 10 (ten) calendar days before the payment date of every pre-authorized debit.

    c. With respect to a pre-authorized debit plan that provides for the issuance of a pre-authorized debit in response to a direct action of mine (such as, but not limited to, telephone instruction) requesting the Town of Diamond Valley to issue a pre-authorized debit in full or partial payment of a billing received by me for a payment obligation that meets the requirements of Section 2 of Rule H1, no notice is required.

    7. I acknowledge that the Processing Institution is not required to verify that a pre-authorized debit has been issued in accordance with the particulars of the Authorization including, but not limited to, the amount, or that any purpose of payment for which the pre-authorized debit was issued has been fulfilled by the payee as a condition to honoring a pre-authorized debit issued or caused to be issued by the Town of Diamond Valley on the Account.

    8. Revocation of the Authorization does not terminate any contract for goods or services that exists between me and the Town of Diamond Valley. The Authorization applies only to the method of payment and does not otherwise have any bearing on the contract for goods of services exchanged.

    9. An NSF fee of $25.00, as provided for by the Town of Diamond Valley policy, shall be charged for any installment that fails to be honored by the processing institution.

    10. I may dispute a pre-authorized debit only under the following conditions:

    a. The pre-authorized debit was not drawn in accordance with the Authorization.

    b. The Authorization was revoked.

    c. Pre-notification, as required under Section 6, was not received.

    11. I have attached a photo or scan of a specimen cheque marked “VOID” to this Payor Authorization (the “Authorization”). 

    12. I will inform the Town of Diamond Valley, in writing, of any change in the information provided in this Authorization ten (10) days prior to the next due date of the pre-authorized debit. 

    13. I agree that the information contained in the Authorization may be disclosed to Alberta Treasury Branches as required to complete any pre-authorized debit transaction. 

    14. I understand and accept the terms of participating in this pre-authorized debit plan and agree to be bound by its terms.

  25. About  eServices

    The Town of Diamond Valley is able to send out Utility Bills and Tax and Assessment documents via email through our eServices program in accordance with the Town of Diamond Valley eServices Bylaw 2023-17 (or as amended or replaced).

    By using this service, you can reduce paper mail and view your notices and bills easily from your computer or mobile device. Choosing to sign up for eServices will not affect the way you pay your taxes or utility bills. 

    All utility billings will be electronically delivered to the email address you provide to us. If the electronic documents are not deliverable, you will be removed from the program and a paper copy will be mailed to you. PLEASE NOTE: If you change your email address, you are responsible to contact the Tax and Utility Department with your new information. Non-receipt of your electronic documents is not justification for late payment, and penalties will apply to all late payments as applicable.

    By joining the eServices program, be advised that a paper copy of the bill or notice will not be automatically mailed, but paper copies may be provided if requested. To request a paper copy of your bill or notice or if you decide to opt out of the eService program and return to paper billing, simply email your request to info@DiamondValley.town or call the Town Office at 403-933-4348.

    If the Account Holder has more than one property, each property must be agreed to separately.
